MEDICAL MANAGEMENT POLICY

PURPOSE

To outline the means by which West Virginia University makes informed and responsible decisions concerning the employability of an individual whose work performance or conduct may be the result of mental, physical, or emotional impairment.

SCOPE

All faculty, faculty equivalent/academic professional (FE/AP), classified and non-classified employees, including those on the regional campuses, are covered under this policy.

POLICY

WVU seeks to provide a safe and appropriate work environment for its employees, to avoid jeopardy to employee health, and to appropriately facilitate employees in their work efforts. Under certain conditions such as health and safety concerns, requirements of federal or state law, or medical leave verification, the University may require an employee to undergo one or more medical examinations. Such exams will be performed at the University’s expense.

The result of medical examinations and any associated reports will be shared with the employee and will serve as a basis for making administrative decisions related to job retention, reassignment efforts, reasonable accommodations, job separation, and other personnel matters related to the affected employee.

University officials/administrators will be granted access to an employee’s medical records on a need-to-know basis only. The confidentiality of each employee’s medical record will be maintained except under legal subpoena or when the contents are incorporated into a recommendation regarding the status of the employee.

PROCEDURE

Additional information regarding this policy or the proper procedure to follow can be obtained in the Medical Management procedure.
