UNEMPLOYMENT COMPENSATION CLAIM POLICY

PURPOSE

To outline the manner in which West Virginia University administers unemployment claims in accordance with WV Code 21A.

SCOPE

This policy applies to all individuals employed at West Virginia University, including those on the regional campuses.

POLICY

The law requires that an employee must have received prior written warning for acts of misconduct before termination of employment; otherwise the employee will become eligible for Unemployment Compensation benefits, unless dismissed for a gross misconduct offense. When an employee terminates employment without good cause, through no fault of the University, the employee is disqualified for Unemployment Compensation benefits. Employing units are to direct all forms, correspondence and other communications from any State Department of Employment Security to the Department of Human Resources for proper completion and to ensure record accuracy.

RESPONSIBILITY FOR IMPLEMENTATION

The employing department, in conjunction with appropriate personnel in the Department of Human Resources is responsible for ensuring the proper completion and processing of unemployment claims. The Medical Management Unit in the Department of Human Resources, at 293-5700 or P.O. Box 6640, is available to answer questions or provide additional information regarding this policy.

RESPONSIBILITY FOR INTERPRETATION

The responsibility for interpretation of this policy rests with the Director of Human Resources, West Virginia University.
