SENIORITY FOR OVERTIME SCHEDULING OF CLASSIFIED EMPLOYEES POLICY
PURPOSE
To outline the means by which West Virginia University will consider seniority for the scheduling of overtime in accordance with the Fair Labor Standards Act, the WV Board of Trustees Classified Employee Handbook and instruction.
SCOPE
All classified non-exempt employees at West Virginia University, including those on the regional campuses, are covered under this policy.
POLICY
Based upon the operational needs of the unit, overtime may be necessary. Overtime will be equalized among employees by offer of such assignments to qualified employees in descending order of seniority; subsequent overtime opportunities are offered to the next senior eligible employee. If the overtime offer is refused by all eligible employees, the assignment will be made to the least senior employee qualified to perform the work; subsequent overtime opportunities will be assigned in ascending order of seniority. For the purpose of this policy seniority begins the first day of the current full-time regular position held within the unit; is continuous full-time regular service; is pro-rated by FTE; and, time off the payroll is not included. If an employee refuses an overtime opportunity he/she will not again be eligible until the full list of eligible employees have been offered overtime.

RESPONSIBILITY FOR IMPLEMENTATION
The supervisor must determine the pool of employees eligible for an overtime assignment based upon work need and the position qualifications, then assign overtime consistent with this policy. The Employee Relations Unit in the Department of Human Resources, at 293-5700 or P.O. Box 6640, is available to answer questions or provide additional information regarding this policy.
RESPONSIBILITY FOR INTERPRETATION
The responsibility for interpretation of this policy rests with the Director of Human Resources, West Virginia University.
