RESIGNATION POLICY
PURPOSE
To outline the manner in which West Virginia University administers the voluntary termination of an employee, in accordance with Board of Trustees Classified Employee Handbook, Board of Trustees Series 35, and the Consolidated Omnibus Budget Reconciliation Act of 1985 (COBRA).
SCOPE
This policy applies to all classified, non-classified, faculty, and faculty equivalent/ academic professional (FE/AP) positions at West Virginia University, including those on the regional campuses.
POLICY
Resignations will be regarded as permanent and the individual will, as of the termination date, forfeit all eligibility for continued service and benefits in accordance with University and Board of Trustees policies, contracts, and state and federal laws.
The employee should submit a signed and dated resignation letter or statement to their immediate supervisor. If an employee provides verbal rather than written notice of their intention to terminate employment, the supervisor will have a confirmation of the resignation prepared and provided to and/or signed by the terminating employee. A copy of the letter will be forwarded to the Department of Human Resources. Two weeks prior notice is required; a shorter notice may be provided if authorized by the supervisor. The employee is to be present and functioning at their position as scheduled during the notice period. Employees are to pay any monetary obligations to the University, and return all University property, equipment, identifications cards, keys, documents, etc. on or before their last day present at the work site. Failure by the employee to meet these obligations will result in termination in poor standing, which may restrict re-employment at the University. Resignation is considered effective the last day present at the work site.
Employees are advised to contact the Benefits Office regarding health insurance options and retirement account(s) information. Resigned employees may opt for continuation of health benefits under COBRA. Benefit eligible employees must sign a PEIA termination form upon termination. Employees will be compensated for accumulated annual leave upon termination of service. During the terminal period no annual or sick leave will be earned.

RESPONSIBILITY FOR IMPLEMENTATION
The employing unit is responsible for ensuring employee compliance and the proper processing of documents required for a resignation. The Benefits and Employee Relations Unit in the Department of Human Resources, at 293-5700 or P.O. Box 6640, are available to answer questions or provide additional information regarding this policy.
RESPONSIBILITY FOR INTERPRETATION
The responsibility for interpretation of this policy rests with the Director of Human Resources, West Virginia University.
