LEAVE GRANTING FOR EMPLOYEE’S ATTENDANCE AT GRIEVANCES POLICY
PURPOSE
To outline the means by which West Virginia University in accordance with WV Code §29-6A and the Fair Labor Standards Act will authorize leave with pay for employees engaged in grievance activity.
SCOPE
All full-time and part-time regular employees at West Virginia University, including those on the satellite campuses, are covered under this policy.
POLICY
Grievance participants and other employees involved in the grievance process will not be required to charge leave, or lose pay or other benefits for time spent in process-required meetings which occur during their regularly scheduled work hours. Such time is to be authorized as work release time.
A maximum of four (4) hours per grievance in time spent by employees to meet with individuals, other than their supervisors, to discuss their work-related concerns or complaints or to prepare for grievance meetings is considered work release time. For any additional time, the employee must obtain approval in advance from their immediate supervisor to be absent from work to attend such meetings. Such time is to be charged to leave or made-up within the workweek.
The employee may be required to provide notice requesting time away from work for grievance activities, consistent with established departmental procedures.

RESPONSIBILITY FOR IMPLEMENTATION
The supervisor has the responsibility to monitor, regulate or limit the time an employee spends away from their assigned duties for grievance activities. The Employee Relations Unit in the Department of Human Resources, at 293-5700, extension 5, or One Waterfront Place (P.O. Box 6640), is available to answer questions or provide additional information regarding this policy.
RESPONSIBILITY FOR INTERPRETATION
The responsibility for interpretation of this policy rests with the Assistant Vice President for Human Resources, West Virginia University.
